On June 8, 2010, by Deed of Trust placed of record on June 15, 2010, at 3:44 p.m., in Record Book 132, Page 323, in the office of the Register of Deeds for Stewart County, Tennessee (the "Deed of Trust"), Thelma Hedrick (the "Mortgagor") conveyed to Jonathan R. Vinson, Trustee, (the "Trustee") the hereinafter described real estate, to secure the payment of a promissory note as described therein (the "Note"), payable to the order of F & M Bank (the "Holder").

The Deed of Trust provided that in the event of default in the payment of the Note, when due, then the entire balance of the Note shall, at the option of the Holder, become due and payable immediately; and, default having been made and continued in the payment of the Note, the Holder of the Note, has declared the entire balance of the Note due and payable as provided in the Deed of Trust. The Holder, in accordance with the terms and conditions of the Deed of Trust, has instructed the Trustee to foreclose the lien of the Deed of Trust.

NOW, THEREFORE, by virtue of the authority vested in the Trustee under the Deed of Trust, the Trustee will, on Tuesday, September 29, 2020, at 11:00 a.m., prevailing time, offer for sale and sell at the front door of the Stewart County Courthouse, Dover, Tennessee, to the highest and best bidder for cash, and in bar of the rights of redemption, homestead and all other exemptions of every kind which the Mortgagor of the Deed of Trust or anyone claiming under or through the Mortgagor may have, all such rights and equities having been expressly waived in the Deed of Trust, the following described real estate situated in Stewart County, Tennessee, to-wit:

Being real estate situated in the 5th Civil District of Stewart County, Tennessee described as follows, to-wit:

Beginning at a concrete marker on the east side of Old Highway 79; thence running 33 poles in a southeasterly direction, with a blazed line to a stone in Koppers Co. west line; thence northwardly with Koppers Co. west line to a stone in Indian Mound and Dover graveled road; thence westwardly with said road 27 poles to Old Highway 79; thence southwardly with Old Highway 79, 11 poles to the beginning, containing by estimation 5 acres, more or less.

This being the same property conveyed to Thelma Hedrick by quitclaim deed dated June 8, 2010, executed by Elmer E. Keatts of record at Record Book 132, page 321, Register's Office for Stewart County, Tennessee.

Said sale will be held subject to (1) all accrued taxes; (2) Affixation Affidavit of record in Record Book 132, Page 330, Register's Office, Stewart County, Tennessee; (3) UCC Fixture Filing filed by Aqua Finance, Inc., in Record Book 222, Page 337, Register's Office, Stewart County, Tennessee; (4) rights of tenants in possession under unrecorded lease(s), only to the extent such lease(s) take priority over the Deed of Trust, pursuant to applicable law; (5) all matters on a recorded plan, restrictive covenants, easements, or setback lines that may be applicable; (6) any matters, liens or encumbrances as well as any priority created by a fixture filing, adverse claims and other matters, only to the extent such matters take priority over the Deed of Trust, pursuant to applicable law; (7) any statutory rights of redemption not otherwise waived in the Deed of Trust, including rights of redemption of any governmental agency, state or federal, which have not been waived by such governmental agency; and, (8) any matter that an accurate survey of the property would show.

Proper notification(s) were provided to the Mortgagor and other appropriate interested parties as required in Tenn. Code Ann. § 35-5-101 et seq. and other written agreements between the parties.

The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place set forth above.

The property address of the real estate that is the subject of this notice is 874 Old Hwy. 79, Dover, Tennessee 37058 (M/P 062-046.00). The reference to the property address and property identification is provided for convenience only. The above-referenced sale will be transferring the property as described in the Deed of Trust, and any discrepancies between the Deed of Trust and the property address/property identification will be governed by the Deed of Trust.

OTHER INTERESTED PARTIES: Lawful Heirs/Devisees of Thelma Hedrick, deceased; and Aqua Finance, Inc.
