NOTICE OF FORECLOSURE SALE OF REAL ESTATE
On September 4, 2012, by Deed of Trust placed of record on September 11, 2012, at 1:30 p.m. o'clock a.m., in Record Book154, Page 632, in the office of the Register of Deeds for Stewart County, Tennessee (the "Deed of Trust"), THOMAS CRAIG WELKER (the "Mortgagor") conveyed to MICHAEL WARREN, Trustee, (the "Trustee") the hereinafter described real estate, to secure the payment of a promissory note as described therein (hereinafter called the "Note"), payable to the order of JOHNSONVILLE TVA EMPLOYEES CREDIT UNION (the "Holder"):
The Deed of Trust provided that in the event of default in the payment of the Note, when due, then the entire balance of the Note would, at the option of the Holder, become due and payable immediately; and,
Default having been made and continued in the payment of the Note, the Holder of the Note, has declared the entire balance of the Note due and payable as provided in the Deed of Trust and, pursuant to the provisions of the Deed of Trust, has instructed the Trustee to foreclose the lien of the Deed of Trust.
NOW, THEREFORE, by virtue of the authority vested in the Trustee under the Deed of Trust, the Substitute Trustee will, on April 2, 2019, at 11:00 o'clock a.m., prevailing time, offer for sale and sell at the front door of the Stewart County Courthouse, 225 Donelson Pkwy., Dover, Stewart County, Tennessee 37058, to the highest and best bidder for cash, and in bar of the rights of redemption, homestead and all other exemptions of every kind which the Mortgagor of the Deed of Trust or anyone claiming under or through the Mortgagor may have, all such rights and equities having been expressly waived in the Deed of Trust, the following described real estate situated in the Fifth (5th) Civil District of Stewart County, Tennessee, to-wit:
BEGINNING on an iron pin in the edge of the Link Highway right of way; running North 56 degrees 30 minutes East 100 feet; North 68 degrees 30 minutes East 100 feet; North 77 degrees 30 minute East 82 feet to a stake; thence North 8 degrees 30 minutes West 265 feet to a 10 inch mountain oak; thence South 86 degrees 30 minutes West 400 feet to a 16 inch hickory thence South 21 degrees 00 minutes East 182 feet to a stake; thence South 23 degrees 30 minutes East 214 feet to the beginning, containing 2.56 acres, more or less, according to survey by W.L. Cook, Dover, Tennessee, No. 279.
INCLUDED on the above described property is a deep well, and the previous grantors, reserve unto themselves, rights to use said well and the rights of ingress and egress over the above described property for the right to lay water lines, to maintain said lines and pump to said well. These rights to be used by grantor on any property he owns at present or might purchase at later times.
Being the property conveyed in Warranty Deed from Thomas E. Welker, and wife, Rita A. Welker to Thomas Craig Welker, dated 08/02/2012, recorded 08/02/2012, in Record Book 153, Page 502, in the Register's Office for Stewart County, Tennessee and having a tax map and parcel number of 46-5.02
Said sale will be only of the rights acquired under the Deed of Trust and held subject to (1) any and all accrued real property taxes; (2) any matters an accurate survey may reveal; (3) well rights and easement of ingress/egress thereto noted in deeds at Deed Book 236, Page 217, Deed Book 244, Page 174, and Record Book 153, Page 502 in the Register's Office for Stewart County, Tennessee; (4) any and all matters, terms, restrictions, easements, or regulations of public record. The trustee makes no warranties to status of title and transfers only those warranties contained in the deed of trust.
The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place set forth above.
