NOTICE OF SALE
Sale at public auction will be on January 31, 2023, at or about 12:00 PM, local time, at the Stewart County Courthouse, 225 Donelson Parkway, Dover, TN 37058, pursuant to the Deed of Trust executed by PENNY A VLCEK AND DAVID VLCEK, wife and husband, to Watson & Atkins PC, as Trustee for Mortgage Electronic Registration Systems, Inc., solely as nominee for ENVOY MORTGAGE, LTD dated March 13, 2014, and recorded on March 13 2014, in Book 171, Page 124, Instrument No. 42676, in the Register's Office for Stewart County, Tennessee ("Deed of Trust"), conducted by Padgett Law Group, having been appointed Substitute Trustee, all of record in the Stewart County Register's Office. Default in the performance of the covenants, terms, and conditions of said Deed of Trust has been made; and the entire indebtedness has been declared due and payable.

The hereinafter described real property located in Stewart County will be sold to the highest call bidder subject to all unpaid taxes, prior liens, and encumbrances of record:
Legal Description: Beginning at an iron pin in the west right of way boundary of Wildlife road 365.0 feet North 52 degrees 15 minutes west of the center of the junction with Highway 49, said beginning point being this tract`s southeast corner and Futrell`s (DB 232, pg 537, ROSC) northeast corner; thence with Futrell South 66 degrees 58 minutes 32 seconds West 389.7 feet to an iron pin; thence generally with a fence North 24 degrees 48 minutes 49 seconds West 212.1 feet to an iron stake; thence North 67 degrees 37 minutes 06 seconds East 404.8 feet to a 12-inch post oak in the west right of way boundary of Wildlife Road; thence with said west right of way boundary 208.3 feet with a curve to the left having a radius of 748.5 feet, a delta angle of 15 degrees 56 minutes 54 seconds, and along chord having a bearing and distance of South 20 degrees 40 minutes 44 seconds East 207.7 feet to the beginning, containing 1.89 acres, more or less, according to a survey by David Hansard, Registered Land Surveyor, License Number 1449, P.O. Box 87, Dover, Tn 37058.. Bearings based on magnetic north (11/2004).
This being the same property conveyed to David Vlcek, and wife, Penny Vlcek, by deed dated March 13, 2014, executed by Karee Webb, now Epps, of record at Record Book 171 page 121, Register`s Office for Stewart County, Tennessee.
Street Address: The street address of the property is believed to be 434 Country Lane, Dover, Tennessee 37058 fka 1132 Wildlife Road, Dover, TN 37058, but such address is not part of the legal description of the property. In the event of any discrepancy, the legal description herein shall control.

This sale is subject to all matters shown on any applicable recorded Plat or Plan; any unpaid taxes and assessments; any restrictive covenants, easements or setback lines that may be applicable; rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of Trust, including rights of redemption of any government agency, state or federal; and any and all prior deeds of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters that may take priority over the Deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this Foreclosure Sale.
THE PROPERTY IS SOLD WITHOUT ANY REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, RELATING TO TITLE, MARKETABILITY OF TITLE, POSSESSION, QUIET ENJOYMENT OR THE LIKE AND FITNESS FOR A GENERAL OR PARTICULAR USE OR PURPOSE. The title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
The right is reserved to adjourn the sale to another time certain or to another day, time, and place certain, without further publication upon announcement on the day, time, and place of sale set forth above or any subsequent adjourned day, time, and place of sale.
If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified check made payable to or endorsed to Padgett Law Group. No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered.
